A bill to amend 1966 PA 225, entitled
"Carnival-amusement safety act of 1966,"
by amending sections 8 and 17 (MCL 408.658 and 408.667), section
8 as amended by 1982 PA 35 and section 17 as amended by 2000 PA
346.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 8. (1) The department shall charge the following Except

6 (5) (2) If the
a fee prescribed by required under subsection
7 (1), (2), (3), or (4) is not received by the department within 30
8 calendar days after notice of the amount due is given, the amount
9
of the fee is automatically
shall be doubled.
10 (3) The department shall review the fees prescribed by
11 subsection (1), shall report to the legislature before October 1,
12 1983 concerning the appropriateness of those fees, and shall make
13 recommendations, if necessary, to reflect actual costs.

Sec. 17. (1) A The director may order a temporary cessation
15 of operations of a carnival-amusement ride may be ordered by the
16 director when the
inspection of a the ride
has been is impeded,
17 obstructed, or interfered with. The order to cease operations
18 shall remain in effect until an inspection has been is made
and
19 the ride has been is
found safe for use.
20 (2) Except for the late payment of fees as provided in
21 section 8(2) 8(5) and except as provided in subsection (3), a
22 person who that violates this act is guilty of a misdemeanor.
23 Each day a violation occurs is a separate offense.
24 (3) The penalty provided in subsection (2) does not apply to
25 the violation of this act by a rider or the rider's parent or
26 guardian.
27 Enacting section 1. This amendatory act takes effect 90 days
1 after the date it is enacted into law.
