A bill to amend 2001 PA 142, entitled

"Michigan memorial highway act,"

by amending the title and section 2 (MCL 250.1002) and by adding section 2a.

the people of the state of michigan enact:

TITLE

An act to consolidate prior acts naming certain Michigan highways in this state; to provide for the naming of certain roads, streets, and highways in this state; to prescribe certain provide for the powers and duties of the certain state transportation department; and local governmental officers and entities; and to repeal acts and parts of acts and certain resolutions.

Sec. 2. (1) The state transportation department shall only provide for the erection and maintenance of suitable markers at the approach of any of the highways described in this act when sufficient private contributions are received if all of the following have occurred:

(a) A private party has provided sufficient money to pay the cost of erecting and maintaining those markers.

(b) A private party has paid at least $3,000.00 into an escrow account established and maintained by the state transportation department for the cost of maintaining those markers.

(c) The highway is named after 1 of the following individuals:

(i) A member of the United States Army, Navy, Marine Corps, or Air Force who died in the line of duty.

(ii) A firefighter who died in the line of duty.

(iii) A police officer who died in the line of duty.

(iv) An emergency medical services personnel who died in the line of duty.

(v) A state correctional officer who died in the line of duty.

(2) As used in this section:

(a) "Emergency medical services personnel" means that term as defined in section 20904 of the public health code, 1978 PA 368, MCL 333.20904.

(b) "Firefighter" means that term as defined in section 2 of the firefighters training council act, 1966 PA 291, MCL 29.362.

(c) "Police officer" means a police officer as that term is defined in section 42 of the Michigan vehicle code, 1949 PA 300, MCL 257.42.

(d) "State correctional officer" means that term as defined in section 2 of the correctional officers' training act of 1982, 1982 PA 415, MCL 791.502.

Sec. 2a. (1) A local unit of government may name any road, street, or highway under its control as a memorial road, street, or highway and provide for the erection and maintenance of suitable markers on those roads, streets, or highways if both of the following have occurred:

(a) A private party has provided sufficient money to pay the cost of erecting those markers.

(b) A private party has paid at least $3,000.00 into an escrow account established and maintained by the local unit of government for the cost of maintaining those markers.

(2) As used in this section, "local unit of government" means a city, county, or village.
