A bill to amend 1949 PA 300, entitled

"Michigan vehicle code,"

by amending section 810 (MCL 257.810), as amended by 2003 PA 152.

the people of the state of michigan enact:

Sec. 810. (1) Except as otherwise provided in subsection (2) or another section of this act, all fees received and money collected under sections 801 to 809 shall must be deposited in the state treasury and shall must be credited to the Michigan transportation fund.

(2) The first $40.00 of each vehicle registration tax collected from a registrant for a vehicle registered under section 801(1)(p) must be deposited in the general fund in a restricted account and distributed, upon appropriation, to the city, village, or township in which the registrant resides. If the amount of the vehicle registration tax collected from that registrant is less than $40.00, the secretary of state must not deposit more than the amount collected. Money in the restricted account at the end of a fiscal year must remain in the restricted account and must not lapse to the general fund. A city, village, or township shall use the money received under this subsection for the repair and maintenance of highways or streets within that city, village, or township. A township may use the money received under this subsection to match money expended by a county or county road commission on highways or streets within the township. As used in this subsection, "county road commission" means that term as defined in section 10c of 1951 PA 51, MCL 247.660c.

Enacting section 1. This amendatory act takes effect 90 days after the date it is enacted into law.
