A bill to prohibit the use of chemical irritants as a crowd control mechanism by law enforcement officers.

the people of the state of michigan enact:

Sec. 1. This act shall be known and may be cited as the "tear gas prohibition act".

Sec. 2. As used in this act:

(a) "Chemical irritant" means a chemical compound that temporarily makes an individual unable to function by causing irritation to the eyes, mouth, throat, lungs, and skin. Chemical irritant includes, but is not limited to, a compound deployed as a gas, commonly known as tear gas or riot control agent.

(b) "Law enforcement officer" means that term as defined in section 2 of the Michigan commission on law enforcement standards act, 1965 PA 203, MCL 28.602.

Sec. 3. A law enforcement officer shall not use a chemical irritant as a crowd control mechanism in this state.
