A bill to amend 1978 PA 368, entitled

"Public health code,"

(MCL 333.1101 to 333.25211) by adding section 5140.

the people of the state of michigan enact:

Sec. 5140. (1) An individual shall wear a face mask at all times while inside a place of public accommodation during the COVID-19 pandemic.

(2) The department shall enforce this section pursuant to sections 2262 and 2263.

(3) As used in this section:

(a) "Coronavirus" means coronavirus disease 2019 (COVID-19).

(b) "COVID-19 pandemic" means the period of time in which a state of disaster or a state of emergency is declared under the emergency management act, 1976 PA 390, MCL 30.401 to 30.421, or a state of emergency declared under 1945 PA 302, MCL 10.31 to 10.33, related to coronavirus.

(c) "Face mask" means a covering for an individual's nose and mouth for sanitary purposes.

(d) "Place of public accommodation" means a business, educational institution, refreshment, entertainment, recreation, health, or transportation facility of any kind, whether licensed or not, whose goods, services, facilities, privileges, advantages, or accommodations are extended, offered, sold, or otherwise made available to the public.
