A bill to amend 1927 PA 175, entitled
"The code of criminal procedure,"
(MCL 760.1 to 777.69) by adding section 12 to chapter III.
the people of the state of michigan enact:
Sec. 12. (1) At every hearing in all
criminal cases in the courts of this state, the court shall provide the defendant
with relevant case dates and deadlines in writing.
(2) Relevant case dates and deadlines, if applicable, that must be provided under subsection (1) include, but are not limited to, the following:
(a) Pretrial hearings.
(b) Discovery deadlines.
(c) Affirmative defense deadlines.
(d) Local court procedure deadlines.
(e) Plea date or cut-off deadline for accepting a plea.
(f) Trial dates.
(g) Sentencing dates.
(h) Appeal deadlines.
(3) If the court fails to comply with this section, the defendant may seek and shall be granted an adjournment, continuance, or delay of the hearing, trial, or other matter for which written notice of the deadline was not provided to the defendant.
(4) The court's failure to comply with this section does not create a civil cause of action against the court, a department, or an individual.
