A bill to amend 1980 PA 299, entitled
"Occupational code,"
by amending section 1108 (MCL 339.1108), as amended by 2014 PA 136.
the people of the state of michigan enact:
Sec. 1108. (1) The department shall issue a license to
practice as a barber to an individual who fulfills all of the following
requirements:
(a) Is not less than 17 years of age.
(b) Is of good moral character.
(c) Demonstrates satisfactory completion of not either of the following:
(i) Not less
than a 1,800-hour course of study at a licensed barber college.
(ii) Subject to subsection (4), a barber
apprenticeship.
(d) Passes an examination approved by the board and
the department.
(e) Has completed the tenth grade of school or has an
equivalent education as determined by the department.
(2) The department shall issue a license as a barber
to an individual who has held a license as a barber in another state,
jurisdiction, or country for 1 out of the 3 years immediately preceding the
date of application if the requirements for licensure in the other state,
jurisdiction, or country are substantially equivalent to the requirements of
subsection (1), as determined by the department. However, the The department may deny or limit a license described in this subsection if the
applicant has been disciplined,
or disciplinary action is pending,
in another state, jurisdiction, or country.
(3) For the purposes of fulfilling the requirement of
subsection (1)(c), (1)(c)(i), an
individual whose instruction as a barber was received in another state,
jurisdiction, or country may substitute experience as a barber or barber
apprentice for instruction in the ratio of 3 months of experience for 100 hours
of instruction. However, if his
or her If the
individual's experience as a barber or barber apprentice was
acquired in a country that the department considers a country from which
records are not generally available, both of the following apply to the
substitution of experience for instruction under this subsection:
(a) He or she The individual may not substitute
experience for instruction under this subsection unless he or she provides a
signed and notarized attestation detailing his or her experience, including his
or her place of employment or apprenticeship, to the department.
(b) He or she The individual may not substitute experience for any of the hours of instruction concerning safety and sanitation, or concerning laws, rules, and regulations, required by the department by rules promulgated under this article.
(4) A barber apprenticeship does not satisfy the requirements of subsection (1)(c)(ii) unless it includes at least a total of 2,000 hours of on-the-job training in all of the following areas for the approximate hours listed below:
(a) A total of at least 550 hours of haircutting, male and female. The 550 hours required under this subdivision must include, at a minimum, each of the following:
(i) 150 hours of regular taper cutting, male.
(ii) 350 hours of hairstyling male, female, and children.
(iii) 50 hours of shaving and beard trimming.
(b) A total of at least 50 hours of facials, male and female.
(c) A total of at least 50 hours of shampooing and scalp treatments.
(d) A total of at least 450 hours of permanent waving. The 450 hours required under this subdivision must include, at a minimum, each of the following:
(i) 150 hours of regular perms.
(ii) 50 hours of partial perms.
(iii) 100 hours of stac perms.
(iv) 150 hours of natural perm curl.
(e) A total of at least 300 hours of coloring hair, male and female. The 300 hours required under this subdivision must include, at a minimum, each of the following:
(i) 150 hours of full color.
(ii) 50 hours of highlighting.
(iii) 50 hours of bleaching complete.
(iv) 50 hours of frosting.
(f) A total of at least 50 hours of hair relaxing.
(g) A total of at least 250 hours of hair pieces. The 50 hours required under this subdivision must include, at a minimum, each of the following:
(i) 100 hours of selling.
(ii) 75 hours of fitting both types, plaster of paris and tape.
(iii) 50 hours of styling and cutting.
(iv) 50 hours of maintaining upkeep.
(h) A total of at least 125 hours of shop management. The 125 hours required under this subdivision must include, at a minimum, each of the following:
(i) Bookkeeping.
(ii) Psychology of working with people.
(iii) Tax service.
(iv) Stock, supply equipment inventory.
(i) A total of at least 100 hours of professional ethics.
