USE OF FORCE RECORD; POLICE S.B. 474:
SUMMARY OF INTRODUCED BILL
IN COMMITTEE
Senate Bill 474 (as introduced 5-25-21)
Committee: Judiciary and Public Safety
CONTENT
The bill would amend the Law Enforcement Officer Separation of Service Record Act to require each law enforcement agency to maintain a record related to a violation of the employing law enforcement agency's use of force policy for each law enforcement officer for whom the agency was required to maintain an employment history record.
The Act requires a law enforcement agency to maintain a record regarding the reason or reasons for, and circumstances surrounding, a separation of service for each law enforcement officer for whom the agency is required to maintain an employment history record under the Michigan Commission on Law Enforcement Standards Act who subsequently separates from a law enforcement agency or from his or her employment as a law enforcement officer requiring the administration of an oath of office.
Under the bill, each law enforcement agency also would have to maintain a record related to a violation of the employing law enforcement agency's use of force policy for each law enforcement officer for whom the agency was required to maintain an employment history record who subsequently separates from a law enforcement agency or from his or her employment as a law enforcement officer requiring the administration of an oath of office.

FISCAL IMPACT
The bill would have a negligible fiscal impact on State or local law enforcement agencies, as the bill would require an agency to make an additional entry into a law enforcement officer's employment record under certain circumstances.
