CONTENT

 

On December 1, 2021, the Michigan Natural Resources Trust Fund (MNRTF) Board adopted fiscal year (FY) 2021-22 recommendations for acquisition and development projects under Article IX, Section 35 of the Michigan Constitution and the Natural Resources and Environmental Protection Act. The recommendation includes $45.6 million for 117 projects. The recommended appropriation would include 22 acquisition projects ($22.3 million) and 95 development projects ($23.3 million). Since its inception in 1976, the MNRTF has been used to fund 2,715 projects totaling $1.3 billion.  

 

MNRTF Background

 

Each year, the MNRTF Board receives project applications from local units of government and the Department of Natural Resources (DNR). These projects are scored by DNR staff using a rubric and then presented to the Board so priority can be assigned and grants can be awarded. The process for selecting projects is outlined in Article IX, Section 35(6) of the Michigan Constitution: The legislature shall provide by law for the establishment of a trust fund board within the department of natural resources. The trust fund board shall recommend the projects to be funded. The board shall submit its recommendations to the governor who shall submit the board's recommendations to the legislature in an appropriations bill.

 

In accordance with the constitution, each year, typically in December, the MNRTF Board votes on applications received for MNRTF projects that year. Before approval is granted, as mentioned above, each project is scored by DNR staff, and the Board meets several times to review projects, hear testimony from interested parties, and discuss the merits of each project. Following the Board's approval, the project recommendations are included in a draft bill that is presented to the Legislature by the Governor. The total dollar amount of these project recommendations is left to the discretion of the Board.

 

The MNRTF was capitalized through deposits of bonuses, rentals, delayed rentals, and royalties collected or reserved by the State under provisions of leases for the extraction of nonrenewable resources from State-owned land. The revenue accruing under leases of State-owned land acquired with money from the State or Federal Game and Fish Protection Fund, is not included. Before 2011, under the Michigan Constitution, annual expenditures consisted of MNRTF interest and earnings and 33% of MNRTF revenue received by the State during the previous fiscal year. These expenditures continued until the corpus of the MNRTF reached $500.0 million, which it did in 2011, thereby limiting subsequent annual expenditures to interest and investment earnings and funding carried forward from previous years.

 

This language was replaced after 2020, when Proposal 2020-1 amended the Constitution. The Constitution now specifies that after the Michigan State Parks Endowment Fund reaches the $800.0 million limit, revenue from bonuses, rentals, delayed rentals, and royalties must be deposited in the MNRFT. The change eliminated the MNRTF's previous $500.0 million cap and allows this revenue to be deposited back into the Trust Fund.

 

The amended Michigan Constitution requires a minimum of 25.0% of Fund revenue to be spent for acquisition, and a minimum of 25.0% to be made available for development. Trust Fund revenue also may be used to pay for the administration of the Fund, as well as for payments in lieu of taxes.

 

Boilerplate

 

Sec. 201. Provides totals for payments to local units of government.

 

Sec. 202. Specifies that appropriations are subject to the Management and Budget Act.

 

Sec. 301. Provides criteria for agreements with local units of government for administration of MNRTF grants.

 

Sec. 302. Provides for work project status of grants. Requires funds to be carried forward consistent with Section 248 of the Management and Budget Act.

 

Sec. 303. Identifies withdrawn projects so that those funds may lapse.

 

FISCAL IMPACT

 

The bill would appropriate $45,592,200 from the MNRTF for 22 acquisition projects and 95 development projects. Matching funds provided by local communities of $39,015,800 for local projects would result in total project costs of $84,608,000. The bill would match the Governor's request in Supplemental 2022-4.

Portage Canal Waterfront Property Acquisition. Acquisition of 2 acres on the Portage Canal in the City of Hancock. Belle River Acquisition. Acquisition of 1/2 of an acre with 160 linear feet of river frontage on the Belle River. The parcel is located at 610 Main Street in Marine City near the downtown area and the confluence of the Belle River and the St. Clair River in St. Clair County. The acquisition will enable future development of a public marina district with amenities to create a new public space and new opportunity in Marine City. Boaters will be able to come in from the St. Clair River and have a great space to tie-off their boats and enjoy a short walk into an exciting waterfront downtown on the St. Clair River. This new water access will also allow for various water recreation opportunities on the Belle River and on the St. Clair River and will provide direct access to and from the Great Lakes.

Hickory Forest Acquisition. Acquisition of 76 acres adjacent to the existing Hickory Hills and Hickory Meadows public recreation areas, bounded on the north by M-72 and on the south by Barney Road. Camp Pishtoning at Pigeon River Acquisition. Acquisition of 404 acres of forestland, including nearly one mile of Pigeon
River corridor, in the Pigeon River Country State Forest. The property is comprised of both lowland conifer forest in some areas along the river and upland cover types including aspen, oak, and pine on the remainder of the parcel. This stretch of the Pigeon River is a designated natural river and is known for its populations of wild brook, brown, and rainbow trout. The property is located in the core of Michigan's elk range and with a combination of both lowland and upland, provides ideal habitat for elk, deer, bear, bobcat, ruffed grouse, woodcock, wild turkey, waterfowl and furbearing species. The Pigeon River corridor also serves as a travel corridor for several of these species, as well as providing habitat for migratory songbirds. The outdoor recreational opportunities on the property would include hunting, fishing, trapping, canoeing, kayaking, hiking, camping and wildlife viewing.

Midland-Freeland Path Connector Acquisition. Acquisition of 1 acre for a multi-use path that is part of the Great Lakes
Bay Regional Trail (GLBRT). The trail will extend toward the existing
Tittabawassee Township Park and trail network which connects trail users to Freeland and Saginaw and is planned to connect to Midland. These parcels will enable trail users to get from the Tittabawassee River to the road right-of-way and township park.

Lake Huron Coastal Preserve Acquisition. Acquisition of 144 acres known as the Lake Huron Coastal Preserve along Lake Huron and US 23 in Alabaster Township, Iosco County. The acquisition will provide public access to over 4,000 feet of Lake Huron frontage and create connections between the Alabaster Bike Path portion of the Iron Belle Trail and the natural area. This will be the first acquisition of its kind in Alabaster Township and along this Lake Huron shoreline. The property contains 60 acres of forested coastal dune and swale, 6 acres of wet meadow, over 4,000 feet of cobble shoreline and northern hardwood forest. Alabaster Township is working closely with Huron Pines, a trusted conservation partner in Northeast Michigan.

Meridian Park Acquisition. Acquisition of 11 acres to expand the 149-acre Meridian Park. This 11-acre parcel is owned by a neighboring farmer and is on the west side of the park. It is a natural area with native foliage, wildlife habitat and large pine trees. This acquisition would provide for the conservation of a natural area that will add better access, including additional trails for park visitors, along with improved access for management activities. Meridian Park is the closest park to the largest city in the County (Mt. Pleasant) and use has grown over the years.

Acquisition of 258 acres within the Waterloo-Pinckney Recreation Area to consolidate state land holdings for recreation and natural resource conservation in an area facing pressure for development. Berrien Springs State Game Area Acquisition. Acquisition of 839 acres for a new State Game Area in Berrien County. The property has approximately one mile of frontage along the St. Joseph River, and it has diverse upland forest habitats, open fields, and wetland areas. The property would be managed primarily for wild turkeys, small game, and deer, and it will provide hunting, fishing, and wildlife-viewing opportunities in an area of the state with a low percentage of public land.

Townsend Park Land Acquisition. Acquisition of 106 acres adjacent to Townsend Park which would bring Townsend Park from large park status to a regional park status with a proposed total of 250 acres. Conceptual planning of the addition envisions 3 miles of trails, an access drive connecting to the existing park, parking for the trail system, and a pavilion that will feature unobstructed views of the surrounding landscape. The property will add significant wildlife habitat, bird watching opportunities and even access to Bear Creek for fishing which is host to brown trout.

Milton Road to Alanson Trail Corridor Acquisition. Acquisition of 15 acres of former railroad right-of-way for the purposes of enhancing the North Western State Trail. The property is immediately adjacent to the existing trail which is located within the US-31 highway right-of-way. Acquisition of the property would allow for immediate use by snowmobiles away from the highway and would allow for future non-motorized trail realignment. It will allow the community to retain the scenic character of the trail for future generations to enjoy. It could provide a location for a trailhead within the Village of Alanson. The trail begins at M-119 in Bear Creek Township and continues north to the Village of Mackinaw City.

Portland State Game Area Acquisition. Acquisition of 66 acres for the Portland State Game Area in Ionia County. Skyline Recreation Area - Inholding Acquisition. Acquisition of 58 acres adjacent to existing city-owned recreation land on three sides. The property would share an existing parking lot for the North Country/Iron Belle Trail on adjacent City-owned property. There would be an increase in recreational opportunity, conservation, and forest management with the addition of this land. Lake Erie Metropark Cherry Island Trail Improvements. Development project to improve the Cherry Island Nature Trail within the 1,607-acre Lake Erie Metropark located at the confluence of the Detroit River and Lake Erie. The project improves accessibility using Universal Design principles, including accessible parking, trails, boardwalks, overlooks, viewing scopes, picnic tables, benches, and bike racks. An existing filled land-bridge, which bisects the river from the wetlands, will be removed and replaced with a boardwalk to restore natural waterflow, improving habitat for fish and wildlife. Visitors to the trail can view American Lotus, a state threatened species, and witness bird migration seasons as the site is part of the International Wildlife Refuge in both Michigan and Ontario.

Hawk Island Park Boardwalk and Fishing Pier. Development project at Hawk Island Park to remove the existing boardwalk along the northeast edge of the pond and install a new accessible floating boardwalk, fishing docks and accessible path approaches. A minimum of 26% of the dock and boardwalk railings will be at a 32-inch height to provide better fishing access and viewing opportunities. Maple Island Boardwalk and Fishing Platform. Development project to replace the 82-year-old pedestrian walkway to Maple Island. The replacement will incorporate 2 new fishing platforms on the bridge, a wider walkway, bench seating, an ADA-compliant pathway to the existing island boat dock, and supporting amenities. The existing bridge is at the end of its life span and replacement is critical to the continued safety of users and their access to recreational activities on Maple Island.

With the removal of the Pucker Street Dam, the City of Niles is investing in the first phase of park redevelopment to create a premier outdoor recreation experience for the community. Fred Thwaites Grand River Trail Reconstruction. Development project to renovate 3.2-miles of the Fred Thwaites Grand River Trail along the Grand River from Ionia Free Fair Grounds to Quarry Road. Along with repaving the existing trail, this project aims to significantly improve the Cleveland Street trailhead. At this newer trailhead, the improvements will include a paved parking lot, benches, picnic tables, a trailhead kiosk, and portable restroom enclosure. Lakeside Park Pavilion and Playground. Development to renovate Lakeside Park with modern restrooms and play equipment. The existing bathrooms were constructed in 1964 and do not meet standards set forth in the Americans with Disabilities Act. The playground equipment that is being replaced is outdated and does not meet current safety standards. Lakeside Park, the most popular of the City's park system, is home to its public boat harbor, beach, and community performance shell. The Park hosts many annual events, including a summer concert series and weekly city band performance as well as the extremely popular Nautical Festival and multiple fishing tournaments.

Idema Explorers Trail - Stearns Bayou Connector. Development of a 2.3-mile trail segment along the Idema Explorers Trail that will provide the final non-motorized trail connection between the existing IET & Grand Haven – completing a 13-mile segment of the IET from the Grand Haven Pier to Riverside Park. This project includes construction of 11,182 feet of a 10-foot wide pedestrian-bicycle asphalt pathway as well as 600 feet of 14-foot wide pedestrian expansion of the Green Street bridge over Stearns Bayou (off the Grand River) and a 400-foot by 14-foot boardwalk over Little Robinson Creek. Douglass Houghton Falls, on Hammell Creek, is Michigan's highest waterfall, falling approximately 110 feet down nearly vertical rock cliffs. The site is noted for its unique regional geology and is named for Douglass Houghton, Michigan's first state geologist. The Hampton Lake Trail parking lot will be enlarged and resurfaced (60 feet x 100 feet) and boulders will be installed to stop vehicle access to the interior of the game area. In addition, a kiosk will be installed with interpretive information and an accessible boardwalk will be constructed leading to a scenic fishing deck and accessible kayak launch on Hampton Lake. Iron Ore Heritage Trail - Marshlands Boardwalk. Development to provide a nature trail experience along the Iron Ore Heritage Trail in Negaunee. Straits State Park Improvements. Development project for the Learning Commons Building as part of the Straits of Mackinac Heritage Center located in the west unit of Straits State Park near St. Ignace, which includes the Father Marquette National Memorial. The Learning Commons is part of a long-range collaborative project between the DNR's Michigan Historical Center and regional partners such as Moran Township, the Sault Ste. Marie Tribe of Chippewa Indians, Mackinac Straits Health System, and Lake Superior State University. The Learning Commons Building will provide learning opportunities around the Anishinaabe and French heritage of the region. Native American perspectives on the natural world will be explored, as well as current and future uses of Michigan's natural resources.
