HOUSE BILL NO. 6436
A bill to amend 1973 PA 196, entitled
"An act to prescribe standards of conduct for public officers and employees; to create a state board of ethics and prescribe its powers and duties; and to prescribe remedies and penalties,"
(MCL 15.341 to 15.348) by adding section 2f.
the people of the state of michigan enact:
Sec. 2f. (1) An elected official or a staff member of an elected official shall not be connected to a 501(c) organization.
(2) As used in this section:
(a) "Connected to" means any of the following with respect to an elected official or a staff member of an elected official:
(i) Is a director or shareholder of the 501(c) organization.
(ii) Is in control of the 501(c) organization.
(iii) Sits on the board of the 501(c) organization.
(b) "Elected official" means an individual elected or appointed to the office of any of the following in this state:
(i) Governor.
(ii) Lieutenant governor.
(iii) Secretary of state.
(iv) Attorney general.
(v) Senate.
(vi) House of representatives.
(c) "501(c) organization" means an organization that claims tax-exempt status under section 501(c)(3) or 501(c)(4) of the internal revenue code, 26 USC 501. 501(c) organization does not include a religious organization.
(d) "Religious organization" means a church, ecclesiastical corporation, or group, not organized for pecuniary profit, that gathers for mutual support and edification in piety or worship of a supreme deity or deities.
(e) "Staff member" means an individual who is hired by and directly reports to an elected official and is employed by the office of the elected official.
