A bill to amend 1994 PA 451, entitled

"Natural resources and environmental protection act,"

(MCL 324.101 to 324.90106) by adding section 5506a.

the people of the state of michigan enact:

Sec. 5506a. (1) If an application for a new or renewal permit under this part is filed on or after the effective date of the amendatory act that added this section, the application and permit, if issued, shall include a plan for the appropriate reduction of emissions to protect air quality on winter thermal inversion action days declared under section 5543 for a geographic area that includes the location of the emissions source. When a winter thermal inversion action day is declared for a geographic area that includes the location of the emissions source, the permittee shall comply with the plan and promptly report to the department, in the manner required by the department, the steps taken for compliance.

(2) If a new or renewal permit issued under this part after the effective date of the amendatory act that added this section provides for an emissions averaging period, both of the following apply during the months of November through March:

(a) The emissions averaging period shall not exceed 8 hours.

(b) During an emissions averaging period, the total duration of exceedances of the average emissions limit shall not be greater than 1/8 of the duration of the emissions averaging period.

(3) As used in this section, "thermal inversion" means that term as defined in section 5543.

Enacting section 1. This amendatory act takes effect 90 days after the date it is enacted into law.

Enacting section 2. This amendatory act does not take effect unless Senate Bill No. 772 of the 101st Legislature is enacted into law.
