A joint resolution proposing an amendment to the state constitution of 1963, by amending section 3 of article VIII, to provide for the election of members of the state board of education from congressional districts.

Resolved by the Senate and House of Representatives of the state of Michigan, That the following amendment to the state constitution of 1963, to provide for the election of members of the state board of education from congressional districts, is proposed, agreed to, and submitted to the people of the state:

article VIII

Sec. 3. Leadership and general supervision over all public education, including adult education and instructional programs in state institutions, except as to institutions of higher education granting baccalaureate degrees, is vested in a state board of education. It shall serve The state board of education serves as the general planning and coordinating body for all public education, including higher education, and shall advise advises the legislature as to the financial requirements in connection therewith.

The state board of education shall appoint a superintendent of public instruction whose term of office shall be is determined by the board. He shall be The superintendent of public instruction is the principal executive officer of a state department of education, which shall have has the powers and duties provided by law.

The Except as otherwise provided in this section, the state board of education shall consist consists of eight members who shall be are nominated by party conventions and elected at large for terms of eight years as prescribed by law. The eight-member state board of education as constituted on December 31, 2024, is abolished at 12 noon on January 1, 2025, and the terms of office of those members of the state board of education expire.

Beginning at 12 noon on January 1, 2025, the state board of education consists of one member elected from each congressional district in this state. For the 2024 general November election, and every eight years thereafter, one individual from each congressional district must be nominated by party conventions for election to the state board of education. Members of the state board of education elected at the 2024 general November election, and every eight years thereafter, serve for a term of office of eight years that begins at 12 noon on January 1 following the election.

Subject to this section, the governor shall fill any vacancy by appointment for the unexpired term. Beginning at 12 noon on January 1, 2025, the governor shall fill any vacancy on the state board of education with an individual who resides in the congressional district from which the vacancy occurs. The governor shall be ex-officio a member of the state board of education without the right to vote.

The power of the boards of institutions of higher education provided in this constitution to supervise their respective institutions and control and direct the expenditure of the institutions' funds shall not be limited by this section.

Resolved further, That the foregoing amendment shall be submitted to the people of the state at the next general election in the manner provided by law.
