HOUSE BILL NO. 4903
A bill to amend 1913 PA 188, entitled
"An act relating to the conduct of hotels, inns and public lodging houses,"
(MCL 427.1 to 427.15) by adding section 3a.
the people of the state of michigan enact:
Sec. 3a. (1) The owner, manager, agent, or any individual in charge of a hotel located in this state shall not rent or lease any room in the hotel to any person unless that owner, manager, agent, or individual in charge of the hotel complies with all of the following conditions:
(a) Gives the person a written schedule that contains the fees charged for smoking in a room at the hotel and verbally instructs the person to review and sign the written schedule received pursuant to this subdivision.
(b) Leaves a copy of the written schedule described under subdivision (a) in a conspicuous area in every room at the hotel.
(c) Posts a copy of the written schedule described under subdivision (a) in a conspicuous place at the hotel.
(2) Before a person checks out of a hotel and upon request of that person, an owner, manager, agent, or any individual in charge of a hotel located in this state must do both of the following:
(a) Inspect the room in the presence of the person checking out of the hotel.
(b) Inform the person, in writing, of whether smoking fees will be assessed against that person based on that inspection. A written notice provided pursuant to this subdivision must be signed and dated by the owner, manager, agent, or individual in charge of the hotel, and must include the following statement if no smoking fees will be assessed: "Room has been cleared and no smoking charges will be assessed.".
