A bill to amend 1978 PA 368, entitled

"Public health code,"

by amending section 16653 (MCL 333.16653), as added by 2018 PA 463, and by adding section 16650.

the people of the state of michigan enact:

Sec. 16650. (1) Subject to this section, if the department requires a licensee to successfully complete continuing education as a condition of license renewal and the licensee is a member of a local, regional, state, or national professional association that has a course the department determines increases the licensee's knowledge of the licensee's health profession, the department shall credit the licensee a number of hours that the department considers appropriate toward the total hours of required continuing education. To receive the credit described in this section, the licensee shall present satisfactory evidence to the department that all of the following are met:

(a) The licensee is a dues-paying member of the local, regional, state, or national professional association.

(b) The licensee is in good standing with the local, regional, state, or national professional association.

(c) The licensee actively participates in the functions of the local, regional, state, or national professional association by doing 1 or more of the following:

(i) Attending a formal meeting or a formal business program hosted by the local, regional, state, or national professional association, if attendance is verified.

(ii) Serving on and actively participating in a local, regional, state, or national board or committee in affiliation with the local, regional, state, or national professional association.

(iii) Participating in industry, regulatory, or legislative meetings held by or on behalf of the local, regional, state, or national professional association.

(2) A licensee shall provide the department with a statement from the local, regional, state, or national professional association confirming that the licensee actively participated in the local, regional, state, or national professional association as described in subsection (1)(c).

(3) The department shall not credit the hours under subsection (1) unless the department, in consultation with the board, approves the local, regional, state, or national professional association as a provider of continuing education under this part. A local, regional, state, or national professional association must not be approved under this subsection unless the department, in consultation with the board, determines that both of the following apply:

(a) The local, regional, state, or national professional association was formed for purposes other than providing continuing education.

(b) The local, regional, state, or national professional association has provided the department with its articles of incorporation on file with the department.

Sec. 16653. As Subject to section 16650, as a condition of renewal of a license to practice under sections 16651 to 16658, a dental therapist shall certify that he or she the dental therapist has successfully completed 35 hours of continuing education in the 2 years before renewal. Continuing education under this section must conform with the requirements of part 161 concerning continuing education courses and must include board-approved courses, including, but not limited to, a course in cardiopulmonary resuscitation.
